Arbitration and human rights - Friends or foe?

At their origins, both international arbitration and human rights were intended as essential components (with others) of a rules-based international order and seen as expressions of what the international rule of law might look like. They were (and are) a means by which the arbitrary exercise of state power is replaced by the exercise of state power subject to independent justice/oversight. However, not only are both (individually and separately) increasingly under attack, they are also frequently seen as being in conflict with each other. Drawing on his extensive experience as an international judge and advocate, in this 9th Luther lecture, Sir Tim will discuss the relationship between international arbitration and human rights in the context of the current challenges to the rules-based international order.

Sir Tim Eicke KCMG KC LLD (h.c.)

Sir Tim is a highly experienced and internationally respected barrister (King’s Counsel) and an arbitrator practising from Essex Court Chambers in London. A dual German/British national, he was called to the Bar in 1993 and appointed Queen’s Counsel in 2011.

Between September 2016 and September 2025, he was the judge elected in respect of the United Kingdom on the European Court of Human Rights and participated in more than 900 reported judgments, advisory opinions and decisions, including most recently the Grand Chamber judgment in Semenya v Switzerland.

He was knighted in the 2026 New Year’s Honours List for “services to the protection of Human Rights in Europe”.

In 2017, he was awarded an honorary doctorate (LLD (h.c.)) by the University of Dundee.
